Terms & Conditions

All orders and deliveries are made under the following terms and conditions:

  1. Customers agree to be bound by Gyan Tara Press’s terms and conditions.
  2. All books are sold under the condition that they shall not be lent, re-sold, hired out, or otherwise circulated without prior consent in any form of binding or cover other than that in which they are published, and without a condition to the same effect being imposed on subsequent purchases.
  3. The price of books is exclusive of any applicable taxes or charges, which the customer shall additionally be liable to pay as shown on the invoice.
  4. Goods are supplied subject to the credit terms and credit limit separately agreed between the customer and Gyan Tara Press. Credit for trade customers can be withdrawn without notice.
  5. Payment shall be made via credit card (Visa, MasterCard) or debit card in INR or other specified currencies.
  6. All proforma invoices are subject to order acceptance and availability of goods. Proformas shall lapse 21 days after issue.
  7. If the customer fails to make any payment by the due date, Gyan Tara Press shall be entitled to charge interest on the unpaid amount at a rate of 3% per annum above the Reserve Bank of India’s base rate.
  8. Costs incurred by Gyan Tara Press in the recovery of debt shall be payable by the customer.
  9. Gyan Tara Press reserves the right to withhold further supplies without prior notice if amounts payable are overdue, if there is a breach of any conditions of this agreement, or for any other reason warranting such action at Gyan Tara Press’s discretion.
  10. Title and ownership of any goods shall not pass to the customer until Gyan Tara Press has received full payment for all goods delivered under this and all other contracts between the customer and Gyan Tara Press.
  11. Delivery of goods is at the customer’s expense and liability. For non-India orders, delivery is sent “Delivered At Place” (DAP), meaning the customer is responsible for any duties and taxes payable to Customs prior to delivery.
  12. Delivery dates are only estimates and not legally binding. Gyan Tara Press uses standard mail delivery services and accepts no liability for delays after goods have left India, including local customs or delivery issues. For guaranteed overseas delivery, please contact us for courier options at an additional fee.
  13. Goods are supplied on a 14-day return basis, assuming they are returned in perfect condition.
  14. Gyan Tara Press will not be liable for shipment charges on returns or changes in book prices between sale and return. Goods are only considered returned when signed for at our offices.
  15. The customer shall inspect goods upon delivery and inform Gyan Tara Press in writing within 48 hours regarding any discrepancies. Replacement may be refused if items are not in stock.
  16. It is the customer’s responsibility to provide Gyan Tara Press with a full and correct postal address. We reserve the right to charge for redelivery if incorrect details are provided.
  17. Subject to these conditions, Gyan Tara Press’s total liability to the customer, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed 100% of the amount payable by the customer under these terms concerning the order giving rise to liability.
  18. Gyan Tara Press shall not be liable for any indirect or consequential loss or damage, including loss of profit, revenue, use, anticipated savings, goodwill, reputation, or opportunity arising from these terms and conditions. Specifically:

i. Gyan Tara Press shall not be liable for delays or failures in performance due to causes beyond its reasonable control.

ii. We shall not be liable for losses arising from failures to fulfill obligations due to events outside our control.

  1. Any agreement for the supply and sale of goods under these terms shall terminate immediately upon any order made for the customer’s bankruptcy or if the customer makes a composition arrangement with creditors, becomes subject to administration, goes into liquidation (except for amalgamation or reconstruction), or if a receiver is appointed over any property or assets of the customer.
  2. Gyan Tara Press reserves the right to terminate supply or orders without notice if immediate action is deemed necessary, particularly regarding any book that may become subject to libel actions or similar concerns.
  3. The agreement for supply of goods shall be governed by the laws of India, and these terms will be interpreted according to these laws.
  4. If any provision of these terms is found to be ineffective or unenforceable, it shall not affect the validity or enforceability of other provisions.
  5. No waiver by Gyan Tara Press of any breach by the customer will be treated as a waiver of any subsequent breach of the same or any other provision.
